NICE Mindset Terms and Conditions
1. Introduction
Welcome to Neurodiverse, Insightful, Coaching, & Empowerment (NICE) Mindset. These Terms and Conditions ("Terms") govern your use of our counseling, coaching, and assessment services, whether delivered in-person or online. By engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.
2. Scope of Services
NICE Mindset provides wellness and coaching services, personal growth coaching, and comprehensive assessments for neurodiverse conditions including Autism Spectrum Disorder (ASD), Dyslexia, and ADHD. Our services include:
One-on-one coaching sessions
Psychological assessments
Personal development support
Mental health support
Neurodiversity empowerment
Our services are not a substitute for emergency medical or psychiatric care. If you are experiencing a medical emergency, please call emergency services or visit your nearest emergency room.
3. Client Responsibilities
As a client, you agree to:
Provide accurate and complete information about your health history, current conditions, and concerns
Actively participate in the counseling or assessment process
Attend scheduled appointments or provide notice of cancellation as outlined in our cancellation policy
Pay for services as agreed
Follow safety recommendations and emergency protocols as advised
Inform us of any changes in your condition that might affect the counseling relationship
4. Consent to Counseling
Before beginning services with NICE Mindset, we require your informed consent. This means you understand:
The nature and purpose of the services being provided
The potential benefits and risks of counseling or assessment
Your rights and responsibilities as a client
The limits of confidentiality
The expected duration and frequency of sessions
For minors, consent must be provided by a parent or legal guardian. In certain circumstances, additional consent forms may be required for specific services or assessments.
5. Confidentiality and Its Limits
We maintain strict confidentiality in accordance with professional ethical standards and applicable laws. However, there are legal and ethical limits to confidentiality, including:
Risk of harm to self or others
Suspicion of abuse or neglect of children, elderly persons, or vulnerable adults
Court orders requiring disclosure
When necessary for professional consultation or supervision
For billing purposes with insurance companies (if applicable)
In these situations, we may be required to break confidentiality to ensure safety or comply with legal obligations.
6. Appointment Booking and Cancellation

Our cancellation policy is as follows:
Cancellations made with at least 24 hours' notice will not incur a fee
Late cancellations (less than 24 hours' notice) may be charged 50% of the session fee
No-shows without notice may be charged the full session fee
Exceptions may be made for emergencies at our discretion
7. Payment and Fees
Payment is expected at the time of service unless other arrangements have been made. We accept various payment methods, which will be communicated to you prior to your appointment.
Fee schedules for specific services will be provided before the commencement of services. Any changes to our fee structure will be communicated with reasonable notice.
If you are using insurance, you are responsible for verifying coverage and understanding your benefits. You remain responsible for any portion of fees not covered by insurance.
8. Record Keeping
We maintain appropriate clinical records in accordance with professional standards and legal requirements. These records include:
Basic identifying information
Session dates and notes
Assessment results (if applicable)
Treatment plans and progress notes
Billing information
You have the right to access your records in accordance with applicable laws, though we may recommend reviewing them together to provide context and support.
9. Privacy and Data Protection
For online services, we use secure, HIPAA-compliant platforms whenever possible. However, no electronic communication can be guaranteed 100% secure. By using our online services, you acknowledge and accept these inherent risks.
We implement reasonable security measures to protect your personal information and will only use it for the purposes outlined in our separate Privacy Policy.
10. Online Counseling Specific Terms
For telehealth services:
You must be physically located in a jurisdiction where we are licensed to provide services
You are responsible for ensuring you have adequate technology (device, internet connection) for sessions
You should ensure you are in a private, secure location during sessions
You agree to provide your current location at the beginning of each session for emergency purposes
Technical difficulties that prevent completion of a session may require rescheduling
11. Crisis and Emergency Procedures
NICE Mindset is not an emergency service. In case of a mental health emergency:
Call 911 or go to your nearest emergency room

We will provide you with a crisis plan if appropriate for your situation.
12. Termination of Services
Either party may terminate services at any time. We encourage a final session to properly close the therapeutic relationship when possible. We may terminate services if:
We determine our services are not appropriate for your needs
You are not benefiting from our services
You have not complied with payment terms
You have repeatedly violated appointment policies
Your behavior has been inappropriate, threatening, or violates our policies
If services are terminated, we will provide referrals to alternative providers when appropriate.
13. Disclaimers
While we strive to provide high-quality services, we cannot guarantee specific outcomes from counseling or assessments. Results vary based on numerous factors, including client participation and individual circumstances.
Our assessments and recommendations are professional opinions based on available information and should not be considered definitive medical diagnoses unless explicitly stated.
14. Amendments to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website or direct notification to clients. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.
